In insurance disputes, one of the main questions to be decided is whether the insurer is obliged to pay the insured. Insurance policies govern the types of losses covered and the liability of the insurer. Therefore, the courts determine insurance disputes based on the coverage of the insurance policy. The insurance company has the power to cancel the coverage if the insured has misrepresented any material facts or for non-payment of premium. If the insured causes any damage voluntarily, the insurer is not under any liability to pay. Bad faith claims of the insured are a valid defense for the insurer to deny the claims. |
